Who this applies to

The rules for using peakplus.pro and buying any Peak+ plan.

These Terms of Service ("Terms") govern your access to and use of Peak+ Services. By using our website or engaging our services, you agree to be bound by these Terms.

1. Services

Peak+ provides social media management, AI integration, content creation, growth strategy, and related professional services. The specific scope of any engagement is defined in a separate proposal, statement of work, or plan subscription confirmed at checkout.

2. Subscriptions & Billing

Recurring plans (Ascend, Momentum, Peak+) are billed monthly in advance through Square. Fees are non-refundable except as set out in our Refund Policy. You authorize us to charge your selected payment method on each renewal date until you cancel.

3. Cancellation

You can cancel any subscription at any time by emailing billing@peakplus.pro Cancellations take effect at the end of the current billing cycle; no partial refunds are issued for unused time unless required by law.

4. Client Responsibilities

You agree to provide timely access to accounts, brand assets, approvals, and information necessary for us to deliver the services. You are responsible for the accuracy and legal rights of all content you supply to us.

5. Intellectual Property

All deliverables produced specifically for you become your property upon full payment. Peak+ retains ownership of pre-existing tools, templates, methodologies, and case-study rights for portfolio use unless otherwise agreed in writing.

6. Confidentiality

Both parties agree to keep confidential information disclosed during the engagement private and use it only for the purposes of performing the services.

7. Disclaimers

Services are provided "as is". We do not guarantee specific results, follower counts, revenue, or rankings. Marketing outcomes depend on many factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, Peak+'s total liability for any claim arising out of these Terms or the services is limited to the fees you paid to Peak+ in the three (3) months preceding the claim.

9. Indemnification

You agree to indemnify and hold Peak+ harmless from any claims arising out of content you supply, your use of the deliverables, or your breach of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes will be resolved exclusively in the state or federal courts located in Delaware.

11. Changes

We may revise these Terms at any time by posting the updated version on this page. Continued use of the services after changes constitutes acceptance.
